MetaleMart - Terms of Use

1. ACCEPTANCE OF TERMS

Your access to and use of MetaleMart is conditional upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, vendors, clients, and others who access or use the Platform. MetaleMart reserves the right to change, amend, or update these Terms at any time at our sole discretion.

2. PLATFORM USAGE

• You may use the Platform solely for lawful business purposes to explore, compare, quote, and purchase metal raw materials.
• Unauthorized use, including scraping, data extraction, or copying of content or code, is strictly prohibited.
• Any automated access, scraping, or indexing of our product database or content without written permission is a violation and legal action will be taken.

3. ACCOUNT REGISTRATION

• You must register for an account to access certain features of the Platform.
• You are responsible for maintaining the confidentiality of your login credentials.
• All information provided must be accurate and up to date.
• We reserve the right to suspend or terminate accounts suspected of misuse, fraudulent activity, or violation of these Terms.

4. INTELLECTUAL PROPERTY

• All content on the Platform including product listings, images, data, design, logos, brand assets, trade names, visual layouts, and written content are the exclusive intellectual property of MetaleMart.
• No portion of the Platform may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form without prior written permission.
• Any unauthorized use will result in legal action, including but not limited to damages, injunctive relief, and compensation claims.

5. PRODUCT LISTINGS & PRICING

• All prices displayed on the Platform are indicative and subject to market fluctuation and material availability.
• Orders are subject to confirmation and availability.
• We reserve the right to modify prices, cancel orders, or change product specifications at any time.
• No responsibility will be accepted for typographical errors or mispricing.

6. TRANSACTIONS & PAYMENTS

• All payments must be made through authorized channels such as UPI, bank transfers, or other supported methods.
• MetaleMart may use third-party payment processors and is not liable for their delays or failures.
• Any refunds or cancellations will be processed at our sole discretion based on order status, product availability, and buyer intent.

7. SHIPPING & LOGISTICS

• MetaleMart facilitates logistics but is not responsible for direct delivery. It is handled by third-party partners.
• Delays due to weather, transport strikes, or third-party errors are not under our liability.
• Delivery timelines are indicative and non-binding.

8. DISPUTES & RESOLUTION

• In case of any dispute, users are expected to first contact us via our support channels.
• MetaleMart's decision in all matters will be final and binding.
• Legal jurisdiction will reside in Mumbai, India.

9. TERMINATION OF ACCESS

• We may suspend or terminate your access to the Platform at our discretion without notice if we find any breach or misuse.
• All obligations under intellectual property, indemnification, and governing law shall survive termination.

10. TERMINATION AND SUSPENSION

• MetaleMart reserves the right to suspend or terminate any user account or access to the platform at its sole discretion without notice, if any user is found violating the Terms of Use or engaging in fraudulent, illegal, or abusive activities.
• We may also terminate access for reasons such as prolonged inactivity, non-payment, or at our sole business discretion.

11. FORCE MAJEURE

MetaleMart shall not be held liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, labour disputes, pandemics, internet outages, governmental actions, or natural disasters.

12. GOVERNING LAW AND JURISDICTION

• These terms are governed by the laws of the Republic of India.
• Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

13. AMENDMENTS TO TERMS

• We reserve the right to update or change these terms at any time without prior notice.
• Continued use of the platform after changes implies acceptance of those revised terms.

14. CONSENT TO WHATSAPP, SMS AND EMAIL COMMUNICATION

• Every account must register and verify a mobile number through OTP.
• By registering or using MetaleMart, you expressly authorise MetaleMart to contact you on your registered mobile number (WhatsApp, SMS and calls) and email address.
• These messages may include OTPs, order and payment updates, cart reminders, rate update requests, enquiries, offers and other service or promotional communication.
• This consent applies even if your number is registered on DND / NCPR.
• You may opt out of non-essential messages anytime by replying "STOP" on WhatsApp or by changing your notification settings. Transaction-related messages (OTP, orders, payments) will continue.
